Terms of Service Agreement

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF OUR SERVICES IS AT YOUR SOLE RISK. OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

4. Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIG BLYMP OR ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR THIS AGREEMENT, EVEN IF BIG BLYMP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

5. No Guarantees:

Big Blymp makes no guarantees regarding the performance, results, or outcomes of its Services. You acknowledge and agree that blockchain technology is still in development and subject to risks, uncertainties, and fluctuations. Big Blymp does not guarantee the accuracy, completeness, or timeliness of any information provided through its Services.

6. Risk Assumption:

You assume full responsibility and risk for your use of our Services and any reliance on the information provided by Big Blymp. You agree that Big Blymp shall not be liable for any losses, damages, or expenses incurred as a result of your use of our Services or reliance on any information provided by Big Blymp.

7. Indemnification:

You agree to indemnify, defend, and hold harmless Big Blymp and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, expenses (including attorneys' fees), and costs arising out of or in connection with your use of our Services or any violation of this Agreement.

8. Governing Law and Dispute Resolution:

This Agreement shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the rules of the Dubai International Arbitration Centre (DIAC).

9. Changes to this Agreement:

Big Blymp reserves the right to modify or update this Agreement at any time without prior notice. Your continued use of our Services after any changes constitutes your acceptance of the revised Agreement.
